Digital Product Terms of Sale

These Digital Product Terms of Sale (“Terms”) govern your purchase, download, and use of digital products and related services offered by DIY Prepper (“we,” “us,” or “our”) through www.diyprepper.com (the “Site”). Our products include The Well-Rounded Prepper Readiness Binder and any related guides, templates, or consultation services (each a “Product” and together the “Products”).
Please read these Terms carefully. By placing an order, completing checkout, or downloading, accessing, or using any Product, you agree to be bound by these Terms. If you do not agree, do not purchase or use the Products.
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to purchase our Products. By purchasing, you represent and warrant that you meet these requirements and that the information you provide at checkout is accurate and complete.
2. About the Products
Our Products are digital reference materials delivered electronically. Depending on what you purchase, a Product may include one or more downloadable files (such as a print-ready PDF binder formatted for single-sided printing and three-ring binder assembly), templates, worksheets, or access to a scheduled consultation service.
The Products are intended as general educational and organizational reference materials for personal emergency preparedness. They are not a substitute for professional advice, emergency services, formal training, or your own independent judgment. See Sections 8 through 12 for important disclaimers.
3. Pricing and Payment
All prices are listed in U.S. dollars unless stated otherwise and are subject to change at any time. The price in effect at the time you complete your order is the price that applies to that order.
Payments are processed through our third-party payment and checkout provider (SureCart) and its integrated payment processors. By purchasing, you agree to that provider’s applicable terms. We do not store your full payment card details. You are responsible for any applicable taxes, fees, or currency conversion charges not collected at checkout.
You represent that you are authorized to use the payment method you provide.
4. Delivery and Access
Digital Products are delivered electronically, typically immediately after payment is confirmed, by download link, account access, or email. No physical goods will be shipped.
You are responsible for:
- Providing a valid, working email address at checkout.
- Downloading and saving your files promptly. Download links or access windows may expire.
- Keeping your own backup copy of any file you purchase.
- Any device, software, internet connection, or printing costs needed to access, print, or use the Products.
If you do not receive access, experience a broken or expired download link, or receive a corrupted file, contact us at diyprepperprojects@gmail.com and we will make reasonable efforts to restore your access to the Product you purchased.
5. License and Permitted Use
Subject to your compliance with these Terms and your payment in full, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Product for your own personal, household, non-commercial preparedness use.
You may:
- Store the Product on devices you own or control.
- Print copies of a purchased printable Product for your own personal, household use.
You may not:
- Resell, sublicense, rent, lease, lend, or otherwise commercially distribute the Product or any part of it.
- Share, post, upload, email, or otherwise distribute the Product or your download link or access credentials to any other person, including through file-sharing services, cloud folders, forums, social media, or messaging apps.
- Reproduce, republish, or redistribute the Product’s text, layouts, graphics, checklists, or other content, in whole or in substantial part, in any medium.
- Create derivative works from the Product for distribution, or incorporate its content into any product or service you offer to others.
- Remove, obscure, or alter any copyright notice, trademark, watermark, attribution, or other proprietary marking.
- Use the Product to train, fine-tune, or develop any machine learning or artificial intelligence model or dataset.
Each purchase entitles a single household to use the Product. Use by an organization, agency, or for training multiple people requires separate written permission. Contact us to discuss group, organizational, or reseller licensing.
We reserve the right to revoke your license and access if you materially breach these Terms.
6. Intellectual Property
The Products, including all text, graphics, diagrams, checklists, worksheets, layouts, design elements, and the compilation and arrangement of that content, are owned by us or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved.
The Well-Rounded Prepper, our brand names, logos, and product names are our trademarks or those of our licensors. Nothing in these Terms grants you any right to use them without our prior written permission.
Where the Products cite, reference, or link to third-party sources (for example, government agencies or standards organizations), those materials remain the property of their respective owners, and their inclusion does not imply their endorsement of us or our Products.
7. Refunds and Cancellations
Digital Products. Because our digital Products are delivered electronically and can be downloaded, copied, and retained immediately, all sales of digital Products are final and non-refundable once the Product has been delivered or the download or access has been made available, except where a refund is required by applicable law. By completing your purchase and accessing the Product, you acknowledge that you are receiving immediate access to digital content and, to the extent permitted by law, you waive any right of cancellation or withdrawal that would otherwise apply once download or access begins.
If you believe you were charged in error, purchased a duplicate, or cannot access a Product you paid for, contact us at diyprepperprojects@gmail.com within 14 days of purchase and we will work with you in good faith to resolve the issue, which may include restoring access or, at our discretion, issuing a refund.
8. Important Safety Disclaimer
Read this section carefully. Our Products address emergency preparedness topics that may include, among others, water, food storage, off-grid cooking, power and heat, shelter, health and first aid, security and firearms, communications, evacuation and mobility, and natural and human-caused hazards.
- The Products provide general information only and are not a substitute for professional advice, hands-on training, certified instruction, the guidance of qualified experts, or the services of emergency responders.
- In any emergency, contact your local emergency services (in the United States, call 911) and follow the instructions of qualified professionals and official authorities. Nothing in the Products should delay or replace that.
- Preparedness activities and the use of related equipment can be inherently dangerous. Examples include, without limitation, fuel and open-flame cooking, generators and carbon monoxide risk, heating equipment and fire risk, water treatment and purification, food preservation, the handling and storage of firearms and ammunition, and physical activity during evacuation. Improper use can result in serious injury, illness, property damage, or death.
- Conditions, equipment, product models, regulations, and best practices change over time and vary by location. Information that is accurate as of the date of publication may become outdated. Always confirm current guidance with the relevant authoritative source and the manufacturer’s instructions for any equipment you use.
9. Firearms and Legal Compliance
Any content relating to firearms, ammunition, self-defense, or security is provided as general information only and is not legal advice, instruction, or encouragement to acquire, possess, carry, store, transport, modify, or use any firearm or other item in any manner.
Laws governing firearms and self-defense vary significantly by federal, state, county, and local jurisdiction and change frequently. You are solely responsible for knowing and complying with all laws, regulations, licensing, storage, transport, and use requirements that apply to you. Before acting on any firearms- or security-related information, consult current legal authority and qualified professionals in your jurisdiction. We disclaim all responsibility for any use or misuse of this information.
10. No Professional Advice
The Products do not provide medical, legal, financial, tax, insurance, engineering, or other professional advice, and using them does not create any professional-client relationship. Health and first-aid content is not a substitute for professional medical care, diagnosis, or treatment, or for certified first-aid, CPR, or emergency training. Always seek the advice of a qualified professional regarding your specific circumstances and any medical condition.
11. Third-Party Content and Links
The Products may reference or link to third-party sources, agencies, standards, organizations, products, or websites for your convenience. We do not control and are not responsible for the content, accuracy, availability, policies, or practices of any third party. A reference or link is not an endorsement, and we make no warranty regarding any third-party material. Your use of any third-party resource is at your own risk and subject to that third party’s terms.
12. Assumption of Risk
You acknowledge and agree that emergency preparedness planning and activities carry inherent risks, and that you voluntarily assume all risks associated with your use of the Products and with any action you take based on them. You are responsible for evaluating your own circumstances, capabilities, equipment, and applicable laws, and for exercising your own judgment and appropriate caution.
13. Disclaimer of Warranties
The Products are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Products will be error-free, complete, current, uninterrupted, or that they will meet your requirements or produce any particular result, level of safety, or outcome.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
14. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will we, our owners, officers, employees, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, property, injury, or other losses, arising out of or relating to the Products, these Terms, or your use of or inability to use the Products, whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Products or these Terms will not exceed the amount you actually paid us for the specific Product giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
15. Indemnification
You agree to indemnify, defend, and hold harmless DIY Prepper and its owners, officers, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Products, your violation of these Terms, your violation of any law or the rights of any third party, or any action you take based on the Products.
16. Changes to the Products and These Terms
We may update, modify, discontinue, or remove any Product or feature at any time. We may also revise these Terms from time to time. The version in effect at the time of your purchase governs that purchase. Changes become effective when posted with an updated “Last updated” date. Your continued use of the Site or Products after changes are posted constitutes acceptance of the revised Terms.
17. Privacy
Your purchase and use of the Site and Products are also subject to our Privacy Policy, available at https://www.diyprepper.com/privacy-policy/, which is incorporated into these Terms by reference.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Products will be brought exclusively in the state or federal courts located in Smith County, Texas, and you consent to the personal jurisdiction of those courts, except where applicable law provides otherwise.
19. Miscellaneous
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms, together with any policies referenced here and the terms shown at checkout, constitute the entire agreement between you and us regarding the Products and supersede any prior understandings.
